Update from Health Squared’s provisional curator

The provisional curator of Health Squared, Joe Seoloane, has issued a communication to members about claims and refunds, waiting periods and legal matters facing the scheme.

There has been a flurry of legal activity since the High Court in Johannesburg placed Health Squared under provisional curatorship on 8 September. However, it has not produced any benefits for members.

The trustees of Health Squared, who want the scheme to be liquidated, filed an application to appeal Judge Allyson Crutchfield’s curatorship order on 19 September.

On 23 September, Acting Judge Swanepoel ordered that Seoloane could not act for the scheme pending the final determination of Judge Crutchfield’s order. The Registrar of Medical Schemes and Seoloane launched applications for leave to appeal Judge Swanepoel’s order.

Judge Swanepoel heard the applications for leave to appeal on 30 September. He ordered that the registrar and Seoloane be granted leave to appeal to the Full Bench of the High Court and extended the Judge Crutchfield’s order to 1 November.

Effectively, this means that Seoloane will continue as the provisional curator.

Waiting periods

Some Health Squared members who have migrated to other medical schemes are being subjected to strict underwriting provisions, including waiting periods for conditions that form part of the prescribed minimum benefits (PMBs).

Seoloane said that in these instances, the Medical Schemes Act allows medical schemes to apply general and/or condition-specific waiting periods in line with their rules. However, such waiting periods should not affect the payment of PMBs.

Seoloane advised members who cannot access medication and or healthcare because of waiting periods to ask the schemes to which they have migrated to waive the waiting periods. However, schemes have the right to make the final decision in this regard.

Claims and refunds

Seoloane said the scheme continues to process members’ claims. The scheme and its administrator were committed to assisting vulnerable members who require access to urgent healthcare services for life-threatening risks, on an ex-gratia basis.

Refunds for members’ contributions and savings account balances are being processed in line with the scheme’s rules. Based on the rules, savings account refunds are released to members four months after resignation from the scheme.

Requests for contribution refunds are being assessed and paid as they are received by the scheme in accordance with its payment processes.

  1. When will Health Squared be reimbursing the Savings accounts of members given that the 4 month notice period in terms of medical aid regulations expired on the 31st December 2022?
    I expected to have my refund already in January 2023.

    Tried calling this company, telephone not answered professionally, the lady on the board does not know what I am talking about. Requested to be put through to a person dealing with this. They don’t answer their phone. No response to two e-mails.

  5. I am also waiting for tax certificate. I have had no communication from the curators. Even the Council for Medical Schemes does not know what is going on. I will be going to the newspapers with this if we do not get a response.
